Acceptable Use Policy

The acceptable use policy (AUP) below has the purpose to ensure a responsible use of the net and its resources, and to avoid practices which degrade the usability of the network. It concerns the image and reputation of EVOLINK as a responsible service provider, caring for the security, reliability and privacy of its systems and network.
The hereunder mentioned rules compose a policy for a use of the systems, the network AND EVOLINK’s services that are considered to be acceptable. The Acceptable Use Policy (AUP) can be adapted to follow the evolution in technology, possibilities and Internet capabilities.

1. GENERAL PRINCIPLES
1.1. The CLIENT can  use  the Network only for  lawful purposes. The use of the systems, the Network and services of EVOLINK in violation of Bulgarian and international law and rules is prohibited. This includes, but is not limited to, dissemination of authors’ materials without the permission of their authors, materials officially considered menacing, disgraceful or obscene, as well as materials, protected by trade secrets, regardless of whether the CLIENT is or is not aware of the content of the materials or the respective law. Furthermore, the use of Internet must comply with the terms and conditions of the EVOLINK services.
1.2. EVOLINK reserves the right to remove immediately and without notice any material or data and to block the use of the Network and services by one or more users, when their application, purpose or intent do not comply with the AUP.
1.3. The CLIENT shall be completely responsible for keeping confidential its passwords and CLIENT information for access to the Network and the services provided by EVOLINK, as well as the security of its own network.
1.4. The CLIENT shall indemnify and hold harmless EVOLINK from any claim, advanced by a third party, to the effect that the use of the Network by the CLIENT violates some of the enacted Bulgarian or international laws and regulations. The CLIENT shall defend and pay all claims, judgements, awards, costs and expenses (including any implicit legal charges and fees) finally suffered by EVOLINK, arising out of such claims. The CLIENT shall notify EVOLINK in writing and in good time of any advanced claim, which he is involved in or aware of.
1.5. EVOLINK does not communicate the e-mail addresses or other personal information about its CLIENT to any third party, without their prior consent in writing. The only exceptions are within the scope of judicial investigations, to which EVOLINK will co-operate to the maximum extent possible.

2. The NETWORK AND SERVICES
2.1. The CLIENT is aware that EVOLINK is unable to exercise control over the content of the information passing over EVOLINK network. Therefore EVOLINK is not responsible for the content of any message, irrespective whether the latter has been sent by the CLIENT or otherwise or by a third party – customer of services provided by the CLIENT himself.
2.2. The Network of EVOLINK can be used by the CLIENT to connect with other networks around the world and the CLIENT agrees to abide by the accepted utilisation rules of the respective networks and the services offered via this network.
2.3. Moreover, the CLIENT shall comply with and be in conformity with the Internet protocols and standards.
2.4. The CLIENT has no right to violate and abuse the identity authentication procedures or the security of any device, network or user record of EVOLINK as well of as of any other network and service provided by third parties (known as "cracking" or "hacking"), nor interfere with service to any user, host, or network  of EVOLINK as well as of third parties (known as "denial of service attacks").
2.5. The CLIENT is not allowed to monitor any data, information or communications in someone else’s network or system without the necessary permission duly granted.
2.6. The CLIENT is not allowed to disseminate false data in Internet such as false routing information (including not only announcing of networks, owned by a third party or reserved by IANA - Internet assigned Numbers Authority) or false DNS information.
2.7. The CLIENT shall not falsify his IP address provided to him by EVOLINK aiming at concealing (source IP spoofing) or other information identifying him.
2.8. The CLIENT shall not deliberately disseminate files containing computer viruses and/or damaged data.
2.9. Without prejudice to the foregoing, EVOLINK considers that any application that overloads the network by whatever means will be considered as making profligate use of the network and is as such NOT allowed. Similarly prohibited is the use of IP multicast in a way different from the one provided and co-ordinated by EVOLINK.
2.10. Criminal or civil proceedings can be brought against the CLIENT, who impairs the security of the systems or the network. EVOLINK shall co-operate to the maximum extent possible to any investigation of any suspect in criminal acts or security offence to the systems and networks, carried out by the legitimate authorities.

3. ELECTRONIC COMMUNICATION
3.1. The CLIENT shall not send e-mails to anyone, who is not willing to receive it. It is explicitly forbidden to send unsolicited bulk mail messages ("junk mail" or "spam") of any kind (commercial advertising, political tracts, announcements,...) or to send the same or similar messages to a large number of newsgroups (excessive cross-posting or multiple-posting, known also as "USENET spam").
3.2. The CLIENT is not allowed to forward or broadcast chain letters or malicious e-mail. These rules apply to any Internet-based media and any application, employing Internet in such a way (e.g., usenet news, fax-like documents via Internet). These rules apply even if the CLIENT employs a third party server to broadcast his communications.
3.3. The CLIENT shall not forge email header information.
